Slip or trip and fall accident cases are often brought against business which are open to the public, such as grocery stores, shopping malls, retail stores, gas stations, etc. In many situations, someone who is injured in a slip and fall or trip and fall accident will have no choice but to seek justice in the civil courts. Fall injuries can be severe and lead to significant medical bills and time lost from work.
Many victims of fall accidents ask questions about how long their case will take or what they can expect to happen in their case. Read more about what happens in a civil injury and accident lawsuit in Philadelphia, Part A and Part B – discovery in an accident lawsuit in Philadelphia.
Timeline of Accident & Injury Cases in Philadelphia
The court system in Philadelphia uses a time schedule for each case. All cases will be assigned to one of three tracks: expedited, standard or complex. However, each case is unique and the time lines can and do vary.
Cases on the expedited track will generally be resolved within approximately one year after the Complaint was filed. Initial trial assignments will be made early on in the case. Many accident cases such as car and motorcycle accident lawsuits will be designed for this track.
Cases on the standard track will generally be resolved within 18 months after the Complaint was filed. Other, more complex accident cases will be designated for this track. For instance, slip and fall or premises liability cases with multiple parties tend to be assigned to the standard track.
Cases on the complex track will generally be resolved within 2 years after the Complaint was filed. Products liability actions and medical malpractice cases are usually assigned to the complex track.
