A: Medical negligence or medical malpractice in a hospital or emergency room setting tends to occur due to one, main reason –  the failure to have or update outdated systems, procedures, and protocols. Whether the issue is surgical mistake or misdiagnosis, it is very likely that failure of a hospital or emergency room system or protocol led to the negligence.

For example, a patient who is seen in the emergency room for symptoms related to a stroke may have their diagnostic films mixed up with another patient, or the films may not be reported accurately to the neurologist. The patient is then discharged, only to suffer a stroke hours later. This kind of scenario reflects a fundamental failure of the systems and processes within the hospital, namely, record keeping and radiology department communication.
